Preamble
The Web2day is an event organized in Nantes by the association LA CANTINE as described in the document "Legal Notice" accessible on the dedicated website www.web2day.co (hereinafter "the Site") offering conferences, workshops, showrooms, startup competitions but also concerts around the theme of innovation in digital (hereinafter "the Event") and a closing party: the Dead2day.
The dates and prices of the event are specified on the Site.
The Site is a platform for purchasing tickets for the Event (hereinafter "the Pass"), whose publisher is the association LA CANTINE.
The general conditions of sale of tickets for the Event (hereinafter "these GTC") are concluded between the association LA CANTINE and the Customer as defined below. It is specified that the present GTC do not apply to the structures using a procedure of ad-hoc Order form.
The Customer refers to the person who has identified himself and wishes to purchase one or more tickets for the Event via the Site.
Only the non-professional Customer (job seeker or student) has, in this respect, specific rights detailed in the Consumer Code. The Customer acknowledges that these rights will be called into question if the reservations are concluded, via the Site, on a professional basis.
The Client, a natural person, declares that he or she is at least 18 years old and has the legal capacity or parental authorization to make a reservation on the Site. The Participant is the person registered for the Event by the Client.
The Legal Notices available on the Site also apply to these GTC. All of these contractual documents are binding on the Customer and the Participant.
These GTC are effective as of December 1, 2022.
They may be modified by LA CANTINE at any time in order to integrate, on the one hand, any legislative or jurisprudential modification applicable to e-commerce and, on the other hand, any technical or technological evolution improving the Site.
1 - Purpose
The purpose of these GTCs is to determine the conditions under which the Customer purchases a Pass for the Event on the Site.
Internet users not resident in France wishing to place an order via the Site must check that the law applicable to them authorizes them to carry out this type of transaction. The existence of the Site cannot be qualified as an act of canvassing, but as a contract concluded at a distance.
2 - Presentation of Passes on the Site
2.1 - The association LA CANTINE provides different ways to attend the Event through different Passes. The categories of Passes are described on the Site.
2.2 - The Pass is only valid for the Event it concerns, on the date, at the time and under the conditions indicated on the ticket. This ticket must be kept until the end of the Event.
In the context of Dead2day, any exit is final.
3 - Ordering a Pass
3.1 - Conclusion of the sale - double click
The sales contract is validly formed when, once the Customer has selected the Passes on the Site, he or she has entered the details of the Participants (1st click), has been able to read and accept the GTC, has checked the content of his or her order (the Pass(es) selected and the price(s)), has corrected any errors and has confirmed it by a second click, in accordance with the provisions of articles 1369-1 to 1369-6 of the French Civil Code.
The double-click procedure constitutes consent on the part of the Customer and entails the payment of the sums due for the purchase of the Pass or Passes by the Customer.
In accordance with Article L221-14 of the Consumer Code, any order confirmed by the second click entails an obligation to pay.
3.2 - Confirmation of the formation of the contract
An electronic mail including a link to the GTC will be sent to the Customer's email address in order to confirm the conclusion of the contract on a durable medium and to include all the elements that are subject to the general obligation of information, mentioned in articles L221-5 and L221-11 and following of the Consumer Code.
It is, therefore, strongly recommended that the Customer keep this acknowledgement email.

3.3 - Obtaining the Pass
The Customer and the Participants will receive an email allowing them, via the download link in the email, to download their Pass.
Participants are responsible for printing their Pass.
In the event of loss, theft or illicit use of the Pass, the authenticity of the print-at-home ticket cannot be detected with certainty. Only the first person presenting the ticket or a reproduction thereof will be allowed access to the venue where the Event is taking place. This person is presumed to be the legitimate ticket holder. The responsibility of the association LA CANTINE cannot be sought in this respect. In this case, if the person holding a print-at-home ticket is refused access to the place where the Event takes place, he or she will not be entitled to any refund of the price paid.
3.4 - Proof of transaction
The computerized records, stored in the computer systems of the association LA CANTINE and its provider, in reasonable conditions of security, will be considered proof of communications, orders and payments between the Parties.
4 - Pricing conditions for the Event
The prices indicated on the site are in euros (€) including all taxes. The VAT rate applied is the legal French rate in force. In case of modification of the French VAT rate, the adaptation of the prices including all taxes will be immediate, without prior information.
For Web2day, the schedule of fees is as follows:
Flash sales

- Flash sale #2 on January 25, 26 & 27, 2023: 149€ for a 3-day pass
Sales from March 1 to June 2, 2023
- 3-day pass for the general public: 229 euros
- 1 Day Pass Member of La Cantine : 69 euros
- 3 Day Pass Member of La Cantine: 149 euros
- 1 Day Pass Partner of the event : 69 euros
- 3 Day Pass Partner of the event : 149 euros
- 3-day pass for students and job seekers: 39 euros
- Afterwork pass for Wednesday, May 31: 20 euros
- Afterwork pass for Thursday June 1st : 20 euros.
NB: The afterwork pass gives access to the last conference and to the evening of the day.
For Dead2day, the closing night of Web2day, the schedule of prices is as follows:
Sale from May 2 to June 2, 2023
- 1 place for the Dead2day : 10 euros
NB: Within the limit of 1000 places available:
- The 1 day pass of Friday June 2nd of Web2day includes the access to the Dead2day
- The Web2day 3-day pass includes access to the Dead2day
*Students - IMPORTANT: Your student card must still be valid at the time of the event. An identity check will be carried out on site and entry will be refused, without refund, in case of non-presentation of the required documents (identity card and student card).
Sale during the event
Online sale (imperative) of 1 Day Pass and Dead2day evening :
- 1 Day Pass : 99€ for Wednesday May 31st & Thursday June 1st 2023
- 1 Day Pass : 49€ for Friday June 2nd 2023
- 10€ pass for the Dead2day
The association LA CANTINE can modify the tariffs of one or other of the categories presented above and this, at any time. However, the changes will not apply to orders validly placed (see Article 3.1 above).
5 - Payment
5.1 - The Customer will pay his purchase by credit card at the time of the validation of his order.
5.2 - The Customer expressly recognizes that the communication of his bank card number to the association LA CANTINE is worth authorization to debit his account up to the total amount corresponding to his order. The debit will take place as soon as the contract is formed (see article 3.1 above).
The Site benefits from one of the most effective security systems according to the state of the art and uses the SSL (Secure Socket Layer) encryption process. Thus, only the bank has access to confidential information (card number, date of validity) which is inaccessible to any third party. In case of refusal of the bank, the Customer will be informed by email and the order will be automatically cancelled.
5.3 - The Customer will be able to consult and print his invoice on the confirmation page of his order.
5.4 - The Customer guarantees the association LA CANTINE that he/she has the necessary authorizations to pay via the bank card used by him/her when purchasing the Passes on the Site.
5.5 - The association LA CANTINE can set up a procedure of checking of the reservations intended to ensure that no person uses the banking co-ordinates of another person without his knowledge or the identity of a third. Within the framework of this verification, it can be asked to the Customer to address to the association LA CANTINE by email to bobby@web2day.co a copy recto-verso of an identity paper and/or a copy of the bank card having been used for the payment (copy recto-verso by taking care to leave appearing only the first 4 and the 2 last digits of the number on the front and by masking the cryptogram and the complete number of the bank card which can appear in hollow on the back of the card) as well as a proof of residence.
In the event that fraud is detected and proven, the Customer's bank account will be re-credited and the Pass order cancelled.
6 - The right of withdrawal
6.1 - Only the non-professional Customer (job seeker or student), has a period of 14 calendar days from the date of formation of the contract (see article 3.1 above) to withdraw.
6.2 - Only the non-professional customer (job seeker or student) can exercise this right via the withdrawal form proposed at the end of the GTC or via an email clearly expressing its desire to withdraw to bobby@web2day.co. The association LA CANTINE will acknowledge receipt of the exercise of the right of withdrawal by return mail.
The non-professional customer will not have to justify his decision.
This right of withdrawal is exercised with a penalty of 20€ TTC equivalent to the file fees related to the cancellation of the ticket.
6.3 - The association LA CANTINE undertakes to reimburse the order of the Passes, subject of the retraction, by bank transfer. The reimbursement of the initial purchaser will take place at the latest within fourteen days from the date on which the association LA CANTINE was informed of the decision of the Customer or the Participant to withdraw.
6.4 - Notwithstanding Article 6.1, the withdrawal period cannot be exercised, regardless of the date of purchase of the ticket, once the event has begun.
7 - Completion of the Event - Cancellation - Postponement
7.1 - Access to the event venue is authorized only to the Client or Participant with their Pass. The Client or Participant is checked upon arrival at the venue. Additional checks may be carried out at the entrance to the various peripheral areas.
Movement is free within the Event, within the limits of the accesses authorized by the Pass held by the participant.
Access to the press area is strictly reserved to partners, speakers of the event and journalists holding a press card.
7.2 - In the event of definitive cancellation of the Event at the initiative of the association LA CANTINE, the refund will intervene only in favour of the Customer.
Only the ticket price will be reimbursed, excluding management fees. No additional expenses of any kind (transportation, hotel, parking, etc.) will be reimbursed or compensated.
In addition, refund requests will only be accepted within a maximum of 1 month following the cancellation of the Event.
7.3 - In the event that the Event is postponed, the Customer will be informed as soon as possible by the association LA CANTINE. He/she may either request a refund or an exchange of his/her Pass.
7.4 - In addition to the events usually retained by the French jurisprudence in case of force majeure, the obligations of the association LA CANTINE will be automatically suspended in the hypotheses of events independent of their express will preventing the normal execution of the present GCS, such as earthquakes, fire or flood of the buildings of the Event, the storm, the blocking of the means of transport for some reason that it is, the acts of terrorism, the total or partial strikes external to the association LA CANTINE, the total or partial blocking, regional, national or international of telecommunications and the total or partial blocking, regional, national or international of the data-processing networks.
Is also a case of force majeure, a risk of terrorist attack (precautionary principle) whatever the prefectural decision and finally any restriction related to Covid-19 or another epidemic / pandemic (containment, curfew, official measures taken in case of acceleration of contamination or mutation of the virus, prefectural or governmental bans on gathering and / or receiving the public ...).
LA CANTINE will inform the Customer and the Participant as soon as possible.
The suspension of obligations shall in no event be a cause of liability for non-performance of the obligation in question, nor shall it result in the payment of damages or penalties for delay. It will not proceed to any reimbursement and cannot be held responsible for it.
8 - Responsibility of the Client and/or the Participants
8.1 - Each Pass is nominative and personal. The Participant is required to carry his/her Pass at all times. The Pass may only be resold in compliance with the provisions of the law of 12 March 2012 n°2012-348 on the organization of sporting and cultural events, which prohibits, under penalty of criminal sanctions, the habitual sale of tickets for cultural or sporting events without the express authorization of the organizer or owner of the exploitation rights.
It is strictly forbidden to reproduce, duplicate or counterfeit a Pass in any way whatsoever. The person who has reproduced the Pass and the user of the copy of the Pass are liable to prosecution.
8.2 - The purchase of a ticket implies adherence to the rules and regulations of the venue of the Event, which can be consulted on the Site. The Participant shall strictly comply with said rules and regulations, failing which he/she shall be held liable.
8.3 - Participants are solely responsible for their personal belongings during the Event.
9 - Miscellaneous provisions
9.1 - Image rights
Volunteers of the event as well as professional photographers will be authorized by the organizer to take photos and videos during the whole festival. These can be used and diffused by the organizer on the internet (social networks, website...) and any other communication support.
The Customer is informed that the association LA CANTINE cannot absolutely prevent the taking of photographs and/or the making of audio and video recordings by the other Participants.
9.2 - Mobile Application
Your personal information is used to generate your pass and give you access to the physical event and the mobile application. During the festival, if you let participants or partners scan your badge, then you agree to share your personal information with them.
On the mobile application, if you visit the exhibitor's page, click on one of their advertisements, get in touch with them in any way (make an appointment, contact one of their members etc.), or express an interest in one of their conferences or products, then your personal information will be shared with them.
9.3 - Tolerance
If any provision of these GTC is invalid, it shall be deemed unwritten, but this shall not invalidate all the contractual provisions.
Any tolerance or waiver by one of the Parties, in the application of all or part of the commitments made within the framework of these GTC, regardless of their frequency and duration, shall not constitute a modification of the GTC, nor generate any right whatsoever.
In case of translation of the GTC in a foreign language, only the French version of the text will be considered as authentic.
10 - Settlement of disputes
The present GTC are subject to French law.
In the event of a dispute, the non-professional Customer (job seeker or student) may opt for conventional mediation before the Consumer Mediator or any other alternative dispute resolution method.
If the Customer is a professional, exclusive jurisdiction is attributed to the courts of Nantes.
